It's an overreach by the government into donated land. The previous waqf constitution was already pretty fair. The tribunal consisted of a judge,  a civil servant, and someone versed in Muslim law. If the tribunals decision wasn't to your liking you could contest it in high court and supreme court. 

Now they changed it to dm being the arbiter, and dm is a civil servant who comes under the government. Thereby the government is taking power away from the judiciary and giving it to its executive. It's a land grab aided by a hideous misinformation campaign for the masses to misrepresent the powers of waqf and what they do.

Waqf board has it's beginning connected with the IndoPak partition where the moving Muslims write off their properties in the name of Allah. So the Waqf Board took control of those many properties. Don't know how the waqf works currently and the problems present on their side

President has NO POWER when it comes to passing of any bill from the parliament. The step involves the parliament sending the bill to the president for their assent. If the president denies it for some reason the parliament has two choices - to rectify or cancel the bill or send it back to the president again. Once the bill is sent again (whether or not with any rectifications) the president has NO CHOICE but to approve it. . .

So, it doesn't matter if the president approves the bill right off the bat because she has no power here. If she had not approved it on the first go, the bill would've been sent to her again at which point she would have no choice but to approve it. So, why bother with the delay? Just approve it the first time...

i don't think half the people passed their political science exam in 8th grade because a president literally cannot refuse to give assent to a law she can just send it back for some more amendment but once it comes back again she has to sign it this is not a BJP thing it's literally how it was created she is a ceremonial head of the government kind of like how the king is the ceremonial head of british government.

There are two amendments in this act that I find extremely offensive. 

1. The rule that only those that have been practising Islam for at least five years can donate their property to Waqf. No such restriction exists for any other religion, to mandate it for Islam alone seems discriminatory. 

2. The rule that non-Muslims must occupy two positions in every Waqf board. This is coming from the same parties that mandated that only Hindus can be members of the Tirupati board, but is forcing non-Muslims to manage the affairs of Muslims. This seems grossly unfair but is in line with the Sangh strategy of ensuring that Muslims are second class citizens.

The supreme court cannot do anything.

In the worst-case scenario it can declare the amendment as unconstitutional.

Then, Modi can simply invoke Article 368 or the 9th Amendment to overturn the court's judgement.

Or he can bring an ordinance to overturn the judgement. 

The only thing the supreme court can do is strike down the amendment on the basis of the claim that it violates the BASIC STRUCTURE OF THE CONSTITUTION.

However, this amendment doesn't violate the basic structure of the Indian constitution at all. 

So in short, it is all up to Modi. 

What Modi wants to do? Does he want to overturn the court's judgement by bringing an ordinance, invoking Article 368, or using the 9th amendment.

Won't matter. The appeals court stated that the legal route taken was illegal, but there are other legal routes so either those will be taken. Also, the supreme court will obviously side with him and if in some shocking turn of events they do not he will ignore them and they won't do anything about it. Time and time again he has shown that he will makes shit up and do his own thing and time and time again the powers that be do nothing about it because it suits their needs for the moment. Donald Trump used the tariffs to manipulate the markets for his own stock investment goals. If you read the law or the constitution they are illegal.  The law says you need an emergency and Trump just makes up an emergency.  The constitution says only congress can imposed tariffs. None of that matters. The supreme court will once again bail Trump out and determine they are A OK.

I think this has to do with previous decisions that say lower courts can’t put up nationwide injunctions and being the president railing against judges. Judges are fearful of having their names / families / careers dragged through the mud all for the ego of this doof. If he stops them then the market goes into further chaos. So if he says they are illegal. Then stops them he has to deal with that then he knows it’s going to the Supreme Court anyways cause doof takes everything there because the way the new system is set up everything does and that’s the only check on power doof believes has any authority on him. He lets the Supreme Court finally rule and he just gets off with a weird tweet and goes about his day. And the Supreme Court can deal with the terrorization from doof.
